TERMS OF USE FOR FACE DUCK GAMES

Effective date: July 2, 2026

These Terms of Use (“Terms”) govern your use of the Face Duck Games mobile application (the “App”).
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
  1. ABOUT THE APP
Face Duck Games is a mobile game application that allows users to play games using touch controls, camera-based features, voice input, and head movement controls.
Certain gameplay features may require access to your camera, microphone, or photo library. These permissions are optional, but some features may not work without them.
  1. ELIGIBILITY
You must be at least 13 years old to use the App.
If you are under the age of majority in your country, you may use the App only with the permission and supervision of a parent or legal guardian.
  1. LICENSE TO USE THE APP
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple devices that you own or control.
The App is licensed to you, not sold.
You may not:
  • Copy, modify, distribute, sell, lease, rent, sublicense, or transfer the App;
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except where prohibited by applicable law;
  • Remove copyright, trademark, or proprietary notices;
  • Use the App for unlawful, harmful, fraudulent, or abusive purposes;
  • Interfere with the operation, security, or functionality of the App;
  • Use bots, automation, scripts, cheats, exploits, or unauthorized software with the App;
  • Attempt to gain unauthorized access to the App, its systems, or related services.
  1. CAMERA, MICROPHONE, AND RECORDINGS
The App may allow you to use your camera and microphone during gameplay.
Face and head movement detection used for gameplay controls is processed locally on your device.
Any gameplay video or audio recording created through the App remains on your device unless you independently choose to save, export, or share it using your device’s features.
You are solely responsible for any content you record, save, export, post, or share using the App.
You must not use the App to create, record, share, or distribute content that:
  • Is illegal, abusive, threatening, hateful, harassing, defamatory, obscene, or discriminatory;
  • Violates another person’s privacy, publicity rights, copyright, trademark rights, or other rights;
  • Includes another person without their permission where consent is required;
  • Contains sexual content involving minors;
  • Promotes violence, self-harm, illegal activity, or dangerous conduct;
  • Contains malware, malicious code, or attempts to interfere with devices or services.
  1. YOUR RESPONSIBILITY FOR SHARED CONTENT
The App may allow you to export or share recordings through third-party services, including social media platforms, messaging apps, or your device’s sharing features.
Once you choose to share content outside the App, that content may become subject to the terms, privacy policies, moderation rules, and visibility settings of the third-party service you use.
We are not responsible for how third-party platforms store, display, distribute, remove, or moderate content that you share through them.
  1. ADVERTISING
The App may display third-party advertising.
You may see advertisements from third-party advertising providers, including Google Mobile Ads / AdMob. Advertisements may be personalized where permitted by law and your device settings.
You may manage tracking permissions through your device settings:
Settings → Privacy & Security → Tracking
Denying tracking permission does not necessarily remove advertisements from the App, but it may make ads less relevant.
  1. SUBSCRIPTIONS AND IN-APP PURCHASES
The App may offer subscriptions, premium features, virtual items, or other in-app purchases.
All payments are processed by Apple through the App Store. We do not collect or store your payment card details.
Subscription terms, pricing, billing periods, free trials, renewal details, and cancellation options will be displayed to you before purchase.
Unless cancelled at least 24 hours before the end of the current subscription period, your subscription may automatically renew.
You can manage or cancel subscriptions through your Apple ID settings:
Settings → Apple ID → Subscriptions
Deleting the App does not automatically cancel an active subscription.
Refund requests are handled by Apple under Apple’s applicable refund policies.
  1. CHANGES TO THE APP
We may update, modify, suspend, remove, or discontinue any part of the App at any time.
This may include:
  • Adding or removing games;
  • Changing gameplay mechanics;
  • Changing available features;
  • Changing advertising formats;
  • Changing subscription benefits;
  • Fixing bugs or security issues;
  • Improving performance or compatibility.
We do not guarantee that any specific feature, game mode, skin, item, score, or functionality will remain available permanently.
  1. INTELLECTUAL PROPERTY
The App, including its software, graphics, characters, designs, animations, sounds, gameplay concepts, text, logos, trademarks, and other content, is owned by or licensed to Face Duck Games and is protected by applicable intellectual property laws.
You may not use our name, logos, characters, graphics, or other assets without prior written permission.
“Face Duck Games” and related branding may be trademarks or service marks of their respective owners.
  1. THIRD-PARTY SERVICES
The App may use third-party services, including services for advertising, analytics, subscriptions, purchases, crash reporting, and performance monitoring.
These services may include:
  • Apple App Store;
  • Google Mobile Ads / AdMob;
  • Apphud;
  • Yandex AppMetrica;
  • Meta / Facebook SDK.
Your use of these third-party services may be governed by their own terms, privacy policies, and rules.
We are not responsible for the availability, content, policies, practices, or actions of third-party services.
  1. DISCLAIMER OF WARRANTIES
The App is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law, we make no warranties, express or implied, regarding the App, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, reliability, security, or error-free operation.
We do not guarantee that:
  • The App will always be available;
  • The App will be free of bugs, errors, interruptions, or defects;
  • Gameplay recording or export will always work correctly;
  • The App will be compatible with every device or operating system version;
  • Advertisements, subscriptions, or third-party services will always be available;
  • Your scores, progress, settings, or local data will never be lost.
  1. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Face Duck Games and its owners, developers, contractors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the App.
This includes, without limitation, loss of data, loss of recordings, loss of progress, loss of profits, loss of goodwill, device issues, or damages caused by third-party services, advertisements, shared content, or external platforms.
Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited.
  1. INDEMNIFICATION
You agree to indemnify and hold harmless Face Duck Games and its owners, developers, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising out of:
  • Your use of the App;
  • Your violation of these Terms;
  • Your violation of another person’s rights;
  • Content you create, record, export, share, or distribute;
  • Your misuse of camera, microphone, recording, or sharing features.
  1. TERMINATION
We may suspend or terminate your access to the App at any time if we reasonably believe that you have violated these Terms, misused the App, attempted to interfere with its operation, or created legal, security, or technical risks.
You may stop using the App at any time by deleting it from your device.
Sections that should reasonably survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing provisions, will continue to apply.
  1. PRIVACY
Your use of the App is also governed by our Privacy Policy.
Please review the Privacy Policy to understand how information may be collected, used, and shared in connection with the App.
  1. APPLE-SPECIFIC TERMS
These Terms are between you and Face Duck Games, not Apple.
Apple is not responsible for the App, its content, maintenance, support, or any claims relating to the App.
To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price paid for the App, if any. Apple will have no further warranty obligation with respect to the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
  1. CHANGES TO THESE TERMS
We may update these Terms from time to time.
When we make material changes, we may update the Effective Date at the top of this page or provide notice in the App where required by law.
Your continued use of the App after updated Terms become effective means that you accept the updated Terms.
